Eligibility: The "Sprint Picture Perfect Weekly Camera Phone Giveaway"(the "Sweepstakes") is open only to legal residents of the fifty (50) United States and the District of Columbia who are eighteen (18) years of age or older at the time of entry. Employees, officers, and representatives of Sprint Nextel Corporation ("Sprint"), UMS Fulfillment, Inc. ("UMS"), and their respective related companies, as well as the immediate family (spouse, parents, siblings, and children) and household members of each such employee are not eligible. Subject to all federal, state, and local laws and regulations. Void where prohibited. 2. Timing: The Sweepstakes begins at 12:01 a.m. Eastern Time ("ET") September 1, 2005, and ends at 11:59 p.m. ET, November 2, 2005 (the "Promotion Period"). There will be nine (9) Drawing Periods during the Promotion Period. The first Weekly Drawing Period begins on Thursday September 1, 2005 at 12:01 a.m. ET and ends on Wednesday, September 7, 2005 at 11:59 p.m. ET., each subsequent Weekly Drawing Period begins at 12:00 a.m. ET and ends at 11:59 p.m. ET. Non-winning entries do not carry over into subsequent drawings. Entries online and offline must be received during the Weekly Drawing Periods to be eligible for the drawing corresponding to the week in which it was received. 3. How to Enter: During the Promotion Period, there are 2 ways to enter: 1. Online Method: Visit http://www.sprint.com and follow the links and instructions for entry. Complete the registration form and submit it. You will be given the option of whether or not to receive additional information via email from Sprint. After supplying this information, your entry is complete. 2. Offline Method: Hand print your name, address, day and evening phone numbers, and age on a 3" X 5" piece of paper and send it in a properly stamped envelope to: NEXTEL Picture Perfect SWEEPSTAKES, Dept. 054303, Lubbock, TX 79491-4303.. Limit one (1) entry per envelope. Entries must be postmarked and received in accordance with the dates listed. Mass entries or mechanical reproductions are invalid. Sponsor is not responsible for late, lost, stolen, postage-due, illegible, incomplete entries, which will be disqualified. Entries received will be eligible for the Weekly Drawing corresponding to the Weekly Drawing Period during which it was received. LIMIT: one (1) entry per person, per email address, per Weekly Drawing Period regardless of method of entry. Any attempt by any participant to obtain more than the stated number of plays/entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that participant's plays/entries and that participant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. Sponsor is not responsible for lost, late, incomplete, invalid, stolen, unintelligible or misdirected registrations, which will be disqualified. In the event of a dispute as to any registration, the authorized account holder of the email address used to register will be deemed to be the registrant or player. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. The potential winner may be required to show proof of being the authorized account holder. 4. Drawings: There will be nine Weekly Drawing Periods during the Promotion Period as described above in section 2. All drawings will be conducted on Sponsor's behalf, in a random drawing from among all eligible entries received, by UMS, an independent judging organization whose decisions as to the administration of the Sweepstakes and the selection of potential winners are final and binding in all matters related to this Sweepstakes. Non-winning entries from the Weekly Drawing will not be carried over into subsequent Weekly Drawings. Entrants selected must comply with all terms and conditions of these Official Rules and winning is contingent upon fulfilling all requirements. Potential winners will be notified by mail, email, and or phone. Each potential winner (or parent or legal guardian if winner is a minor) may be required to sign and return to Sponsor, within ten (10) days of the date of notice or attempted notice is sent, an affidavit of eligibility and liability/publicity release in order to claim his/her prize. If a potential winner is a minor, the Prize will be accepted by the minor's parent/legal guardian on behalf of the minor. If a potential winner cannot be contacted, the prize is returned as undeliverable, or a potential winner fails to sign and return the affidavit of eligibility and liability/publicity release within the required time period (if required), potential winner forfeits prize. In the event that a potential winner is disqualified for any reason, Sponsor will award the prize to an alternate winner in a random drawing from among all eligible entries remaining. Only three (3) alternate winners will be selected after which the prize will remain unawarded. Prizes will be fulfilled 8-10 weeks after the end of the Promotion Period. 5. Prizes: Nine (9) Weekly Prizes (One (1) for each Weekly Drawing of the Promotion Period): Winner receives choice of a Nextel i850 by Motorola®, Approximate Retail Value ("ARV"): $399 OR a Sprint PCS Phone MM-A880 by Samsung®, Approximate Retail Value ("ARV"): $329. No substitution (except where indicated herein), assignment, or transfer of prizes permitted, except by Sponsor, who reserve the right to substitute a prize with another of comparable or greater value. Winner is responsible for all taxes and fees associated with prize receipt and/or use including any and all services for activation of phone. Total ARV of both prizes is a maximum of $3,600.00, depending on each Winner's selected prize. Odds of winning depend on the number of eligible entries received. Only one prize per person or household allowed. 6. Publicity: Except where prohibited, participation in the Sweepstakes constitutes winner's (or parent/legal guardian's) consent to Sponsor's use of winner's name, likeness, voice, opinions, biographical information, hometown, and state for promotional purposes in any media without further payment or consideration. 7. General Conditions: Sponsor and UMS reserve the right, in their sole discretion, to cancel, modify, or suspend the Sweepstakes for any cause beyond the control of Sponsor, which, in their sole opinion, corrupt the administration, security, fairness, integrity, or proper operation of the Sweepstakes. In the event of cancellation, Sponsor may elect to identify winners and award the prizes by way of random drawing from among all entrants who had entered the Sweepstakes up to the time of such impairment. Sponsor may prohibit any entrant or potential entrant from participating in the Sweepstakes, if, at the sole discretion of Sponsor, such person (a) shows a disregard for these Official Rules, or any other promotion; (b) acts with an intent to annoy, abuse, threaten, or harass any other entrant, Sponsor, or its agents or representatives; or (c) in any other disruptive manner. Any attempt by any person to deliberately damage any web site or undermine the legitimate operation of the Sweepstakes is a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserve the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. In the event of a dispute as to any text messaging entry, the user identified in Sponsor's billing system for the wireless number used to enter the Sweepstakes will be deemed to be the entrant and must comply with these Official Rules in order to receive a prize. If no user is identified in Sponsor's billing system, then the account holder for such wireless number will then be deemed the entrant and must comply with these Official Rules in order to receive a prize. 8. Release: By entering this Sweepstakes, entrant (or parent/legal guardian) agrees to release and hold harmless, Sprint, UMS, each of their related companies, and each of their respective officers, directors, employees, shareholders, and agents from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt or use of any prize. 9. Limitations of Liability: Sponsor is not responsible for and shall not be liable for: (a) late, lost, delayed, damaged, misdirected, incomplete, illegible, postage due, or unintelligible entries; (b) telephone, electronic, hardware, or software program, network, Internet, computer failures, or difficulties; (c) errors in transmission; (d) any condition caused by events beyond the control of Sponsor that may cause the Sweepstakes to be disrupted or corrupted; (e) any injuries, losses, or damages, of any kind caused by a prize or resulting from acceptance, possession, use or misuse of a prize, or from participation in the Sweepstakes; or (f) any printing or typographical error in any materials associated with these Official Rules or the Sweepstakes generally. 10. Disputes: Entrant agrees that: (a) any and all disputes, claims, and causes of action arising out of or connected with the Sweepstakes, or any prizes awarded, other than the administration of the Sweepstakes or the determination of winners shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Eastern District of Michigan (Southern Division) or the appropriate Michigan State Court located in Oakland County, Michigan; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes but in no event attorneys' fees; and (c) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Michigan, without giving effect to any choice of law or conflict of law rules (whether of the State of Michigan or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Michigan. 11. Winners List: Sweepstakes results and/or a copy of these Official Rules may be obtained by sending a self-addressed, stamped envelope to "Sprint Weekly Camera Phone Giveaway Rules Request", Dept. 054304, Lubbock, TX 79491-4304. Requests for winner's list must be received by November 15, 2005. VT residents may omit return postage for rules requests. 13. Agreement to Official Rules: By participating in the Sweepstakes, each entrant fully and unconditionally agrees to and accepts these Official Rules and the decisions of Sponsor and judges which are final and binding in all matters related to the Sweepstakes. 14.
